Procedure for ensuring that the Association’s waste disposal meets legislative requirements(OP17B:V6:09/01/06)

Responsibility

  1. Works Manager – will ensure that the Association conforms with the duty of care imposed by Part II, s.34 of the Environmental Protection Act (1990) and the Hazardous Waste (England and Wales) Regulations 2005

  2. Skip Lorry Driver – will maintain daily log of waste

  3. Administration Officer – will validate and file weight tickets

Action

  1. The Works Manager will ensure that waste (as defined in the 1994 Waste Management Licensing Regulations) is packed properly to prevent it escaping during transit, and that it is disposed of to an appropriately licensed site.

  2. Before using a “waste carrier” for the first time, the Works Manager will check their registration/licence (copy certificates must be obtained from the Environment Agency).

  3. He will check that the “waste manager” (landfill operator) also has a licence and that the licence permits the manager to take the type and quantity of waste involved.

  4. All the Association’s waste (other than special waste) will be sent to a recycling site wherever economical and practical. The driver of the Association’s skip lorry will keep a daily log of where waste is collected and deposited. The Administration Officer will validate and file all weight tickets, with the date, type of waste and where waste came from.

    Controlled Waste (as defined in Section 1.2 - EPA 1990 Duty of Care, Code of Practice)

  5. In addition if the waste is "Controlled Waste" (which encompasses almost all our waste), the following people will have responsibility for the completion and retention of the transfer consignment notes

    • Support Services Manager- for the disposal of waste from Hanney
    • Office Administrator - for the disposal of waste from Abingdon and Wantage
    • Specialist Services Manager - for the disposal of waste from our Sheltered Schemes
    • Personnel Manager - for the disposal of sanitary waste from all three offices

      The transfer consignment note should include:
    • A description of the waste, including any special problems
    • The quantity of the waste
    • The signatures of the parties involved

      Hazardous Waste (as defined under the Hazardous Waste (England and Wales) Regulations 2005

  6. The Works Manager will ensure that any sufficiently dangerous or difficult wastes (as defined by the Hazardous Waste (England and Wales) Regulations) - see attached appendix) are disposed of by a specialist contractor, to specially designed and protected sites.

  7. Staff will put any Hazardous Waste they generate into a sealed skip, in a bunded area at Hanney prior to disposal by the specialist contractor. The Works Manager will ensure that rain water is pumped out of the bunded area periodically into the foul water drain. If chemicals are spilled in the bunded area they will be pumped into a drum and disposed of with the special waste.

  8. The Works Manager will ensure that the East Hanney premises remain at all times registered with the Environment Agency as a ‘Producer of Hazardous Waste’.

  9. Prior to disposal the Works Manager will ensure that the specialist contractor completes a Hazardous Waste Consignment Note, gives us a copy and sends a copy to the Environment Agency as pre-notification. After disposal of the waste, the contractor must also give a completed copy of the Consignment Note to:

    • The disposal site
    • The Environment Agency

  1. The waste carrier’s certificate of registration (photocopies are not valid)
  2. Written copies or conformation of waste disposer’s licences
  3. Skip lorry driver’s log
  4. File of weight tickets
  5. Controlled waste - Transfer consignment notes (Must be kept for a minimum of 2 years) 
  6. Hazardous waste - Special consignment notes (The green copy must be kept for a minimum of 3 years. A photocopy is not acceptable.)
